29 CFR 1910.95(c)(1): A continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (n) was not instituted when employee noise exposures equaled or exceeded an 8 hour time weighted average sound level (TWA) of 85 dBA: a) In the Production Area, on or about June 20, 2023 - A continuing, effective hearing conservation program was not instituted when employee noise exposures equaled or exceeded an 8 hour time weighted average sound level (TWA) of 85dBA. An employee, designated as a production technician, had an exposure to continuous noise at a dose of 90.9%. The exposure is approximately 1.82 times the OSHA action level of 85 dBA (50%) at which the hearing conservation program is required. This is an equivalent sound level of 89.3 dBA. b) In the Production Area, on or about June 20, 2023 - A continuing, effective hearing conservation program was not instituted when employee noise exposures equaled or exceeded an 8 hour time weighted average sound level (TWA) of 85dBA. An employee, designated as a production technician, had an exposure to continuous noise at a dose of 94.9%. The exposure is approximately 1.90 times the OSHA action level of 85 dBA (50%) at which the hearing conservation program is required. This is an equivalent sound level of 89.6 dBA.

29 CFR 1910.95(g)(8)(ii)(B): Unless a physician determines that the standard threshold shift is not work-related or aggravated by occupational noise exposure, the employer did not ensure, when a standard threshold shift occurs, that for employees already using hearing protectors, employees be refitted and retrained in the use of hearing protectors and provided with hearing protectors offering greater attenuation if necessary: a) In the Production Area, on or about June 20, 2023 - Two employees, both designated as production technicians, were not refitted and retrained in the use of hearing protectors and provided with hearing protectors offering greater attenuation following their standard threshold shifts (STS's) in October 2022. See descriptions of employee noise exposures in Citation 1, Item 1a, Instances a-b.
