29 CFR 1910.213(r)(4):The mention of specific machines in paragraphs (a) thru (q) and this paragraph (r) of this section, inclusive, is not intended to exclude other woodworking machines from the requirement that suitable guards and exhaust hoods be provided to reduce to a minimum the hazard due to the point of operation of such machines. a) On 4/12/2023 the employer did not ensure that the Delta miter saw (model # MS210), where employees were utilizing to cut corners from wooden slats, was properly guarded in that the blade was unguarded, employees were exposed to rotating parts such as the blade, during normal production.

29 CFR 1910.242(a):General requirements. Each employer shall be responsible for the safe condition of tools and equipment used by employees, including tools and equipment which may be furnished by employees. a) On 4/12/2023 the employer did not ensure the safe operating condition for the Delta miter saw (model # MS210) prior to employees utilized the saw to cut pallet slats in that the saw blade was unguarded.
