29 CFR 1926.501(b)(10):Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels and 50-feet (15.25 m) wide or less, was not protected from falling by guardrail systems, safety nets: a) 8-10 E. Scott St., Riverside NJ, upper roof: Employees were observed working on a flat surface roof at approximately 25 feet from the lower level. The employees were exposed to fall hazards without the use of personal fall arrest systems. Observed on or about 4/19/2023 b) 8-10 E. Scott St., Riverside NJ, lower roof: An employee was observed working on a low slope 2/12 pitch roof at approximately 16 feet from the ground. The employee was exposed to fall hazards without the use of a personal fall arrest system. Observed on or about 4/19/2023 NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii) a) 8-10 E. Scott St., Riverside NJ, upper roof: Untrained employees were exposed to a fall hazard of thirty-six feet. Employees were performing roofing duties on a flat roof without the knowledge to operate safely. Observed on or about 4/19/2023 b) 8-10 E. Scott St., Riverside NJ, lower roof: An untrained employee was exposed to fall hazard of sixteen feet. The employee was performing roofing duties on a low slope roof of 2/12 pitch without the knowledge to operate safely. Observed on or about 4/19/2023 NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
