OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employee were exposed to struck-by of molten metal hazards associated with the operation of the excavator hammer attachment machine. a) Yard area: On or about April 14, 2023, and prior to, the employer exposed employees to struck-by hazards from molten metal while operating the Caterpillar, model 336E, SN FJH564 excavator operating with a hammer hydraulic attachment.

29 CFR 1910.22(a)(2): The employer did not ensure that the walking and working surface of the roadway is maintained in a clean and, to the extent feasible, in a dry condition. The employer did not ensure that drainage is maintained to mitigate hazards. a) Harsco slag and pot handling roadway: On or about April 14, 2013, and at times prior to, the employer exposed employees to explosion and fire hazards from not ensuring the working surface roadway were maintained in a dry condition.
