29 CFR  1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck.   a)	Holgate Lumber Co. On or about April 19, 2023 at the address of 10 Turtle Creek Swanton, OH 43558: The employer did not ensure an employee operating a forklift was formally trained (written) in the operation of power industrial vehicles. An evaluation of competency for the employee operating the forklift was not conducted and documented by the employer. The operating employee and others working around the forklift were potentially exposed to struck-by injuries due to operation by an unevaluated operator.

On or about April 19, 2023 at the address of 10 Turtle Creek Swanton, OH 43558: The employer did not ensure the scaffolding platform used to elevate employees via the Sky Trak (model: 5028) telehandler forklift, was designed by a qualified person. Employees performing construction activities in this condition were exposed to a fall of approximately 17 feet

29 CFR  1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:   a)	Holgate Lumber Co. On or about April 19, 2023 at the address of 10 Turtle Creek Swanton, OH 43558: The employer did not ensure employees were protected from falls while working from a  scaffold platform attached to a telehandler (all-terrain) forklift. Employees performing framing work activities from the platform with the gate open were exposed to fall hazards of 17 feet or greater to the ground below.

On or about April 19, 2023 at the address of 10 Turtle Creek Swanton, OH 43558: The employer did not ensure employees were protected from falls while performing framing work activities (installing plywood sheathing) atop a single-story commercial structure. Employees operating in this condition were exposed to fall hazards between 9' - 25' to the ground below.
