29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (a) On or about 4/20/2023 at 6025 Shiloh Road, Suite E, Alpharetta, GA 30005, where the use of respiratory protection is required including but not limited to half face mask was necessary for employees that are spraying in a spray booth, the employer did not ensure that medical evaluations were conducted prior to providing respirators for use.
