29 CFR  1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions.  a) 618 S 29th St. Harrisburg, PA 17111 - Employees were operating equipment including, but not limited to, a pneumatic nail gun for framing and sheeting work activities.  The employer did not require employees to wear appropriate eye/face protection while operating the pneumatic nail gun, on or about April 21, 2023.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.95(a):  Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition and it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact:  a) 618 S 29th St. Harrisburg, PA 17111 - Employees were operating pneumatic tools to include nail guns to installing roofing shingles on the roof and were not provided with safety-toe protective footwear for protection from punctures. 29 CFR 1926.1053(b)(1):  Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder:  a) 618 S 29th St. Harrisburg, PA 17111 - the ladder being used by the Heritage Roofing Systems, LLC to access the roof for shingle replacement was not extended at least three feet above the upper landing surface. The ladder was set at the bottom of the roof box which required the workers to climb onto the roof.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  a) 618 S 29th St. Harrisburg, PA 17111 - Employees were observed working on a residential roof 10 - 12 feet above the lower level with a 3 in 12 pitched roof without a fall protection system in place, exposing the employees to a fall hazard, on or April 21, 2023.   Heritage Roofing Systems was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.501(b)(13)), which was contained in OSHA inspection number 1414717, citation number 1, item number 1 and was affirmed as a final order on August 21, 2019, with respect to a workplace located at 290 Ridge Road Spring Mills PA.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
