29 CFR  1910.147(c)(4)(i): Procedures were not  utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:   On or about March 27, 2023 at 870 West Main Street, East Palestine, OH 44113, the employer failed to ensure employees performing work on the RMH29 Refractory Mud Hog Mixing Station utilized written lockout/tagout procedures prior to reaching inside of the machine to retrieve a cutting knife that had fallen in.

29 CFR  1910.212(a)(2): Machine guard(s) on machine(s) were so installed that they offered accident hazards in themselves:  On or about March 27, 2023, at 870 West Main Street, East Palestine, OH 44113 the employer failed to ensure employees operating the RMH29 Refractory Mud Hog Mixing Station were protected against injuries associated with the machine guard. The machine guarding is a steel guard with 4 inch X 4 inch openings. An employee stuck their hand in between the openings and came into contact with the rotating mixing blade breaking their arm against the guard opening.

29 CFR  1910.212(a)(3)(ii): The  point of operation of machines whose operation exposed an employee to injury, was not guarded:   On or about March 27, 2023, at 870 West Main Street, East Palestine, OH 44113 the employer failed to ensure employees operating the RMH29 Refractory Mud Hog Mixing Station were protected against coming into contact with the rotating blade in that employees can reach into the mixing station while it is operating.

29 CFR  1910.1053(d)(1):The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of this section:  On or about March 27, 2023  at 870 West Main Street, East Palestine, OH 44113, the employer failed to perform monitoring for employees exposed to crystalline silica. Employees utilize Reno Cast 65 CLC mixture which contains 0.9-1.33 percent crystalline silica to make refractory bricks.

Employees were at four years during the inspection without being evaluated.
