OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by equipment and materials:  (a) On or about April 19, 2023, at a residential lot, an excavator that was being used to lift and place concrete blocks during construction of a retaining wall was positioned on a downward slope of soft fill dirt and operated in close proximity to workers, exposing employees to a struck-by hazard.

29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  (a) On or about April 19, 2023, and at times prior, at a residential lot, employees working in close proximity to an excavator that was being used to lift and place concrete blocks during construction of a retaining wall were not protected from head injuries from impact or falling or flying objects.
