29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: (a) 141 Claiborne St. Biloxi, MS. - On or about April 21, 2023, the employer allowed his employees to work inside the trench, under the two excavators buckets that were digging and placing water lines without the protection of hard hats exposing employees to struck by hazards.

29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations, or by a combination of both if necessary. (a) Both sides of trench - On or about April 21, 2023, the employer instructed employees to work from inside the open trench to fasten water pipe while the spoil pile was at the edge of the trench exposing employees to engulfment hazards.
