29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying objects while using a nail gun.  Location: 29 Pentucket Ave, Lowell, MA;  On or about 04/21/2023, employees were exposed to eye or face hazards while operating nail guns without eye protection during roofing activities.  Segundo Joaquin Acero Chuma DBA Pro Mass Construction Inc was previously cited for a violation of this occupational safety and health standard 1926.102(a)(1), which was contained in OSHA inspection number 1443638, citation number 1, item number 2 and was affirmed as a final order on 02/13/2020, with respect to a workplace located at 472 NH-111, Hampstead, NH 03841.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  Location: 29 Pentucket Ave, Lowell, MA;  On or about 04/21/2023, five employees were observed working  from some combination of the lower and main roofs of the residence at heights 9 and 17-feet above a lower level who were not protected by fall protection.  Segundo Joaquin Acero Chuma DBA Pro Mass Construction Inc was previously cited for a violation of occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 1443638, citation number 1, item number 3 and was affirmed as a final order on 02/13/2020, with respect to a workplace located at 472 NH-111, Hampstead, NH 03841.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access.  Location: 29 Pentucket Ave, Lowell, MA;  On or about 04/21/2023, there were three separate portable extension ladders which were utilized by employees to gain access to the 9-foot and 17-foot roof sections of the residence which were not 3-feet above the landing surface.  Segundo Joaquin Acero Chuma DBA Pro Mass Construction Inc was previously cited for a violation of this occupational safety and health standard 1926.1053(b)(1), which was contained in OSHA inspection number 1443638, citation number 1, item number 5 and was affirmed as a final order on 02/13/2020, with respect to a workplace located at 472 NH-111, Hampstead, NH 03841.
