1926.454(c)(3) Where inadequacies in an affected employee's work involving scaffolds indicate that the employee has not retained the requisite proficiency. [61 FR 46025, Aug. 30, 1996] 29 CFR 1926.453(b)(2)(iv):Employees shall always stand firmly on the floor of the basket, and shall not sit or climb on the edge of the basket or use planks, ladders, or other devices for a work position. a) On or about 04/20/2023, during the construction of the BJ Brewhouse, located on 760 Jefferson Road, in Rochester, New York, the employer did not enforce the safe operating use of an aerial lift during the application of EIFS (Exterior Insulation Finishing System). Employees were allowed to climb on the boom basket guardrails exposing them to fall hazards while working 14 feet above lower levels. NO ABATEMENT CERTIFICATION REQURIED

29 CFR 1926.453(b)(2)(v): A body belt (harness) shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. a)On or about 04/20/2023, during the construction of the BJ Brewhouse, located at 760 Jefferson Road (Market Square Plaza) in Rochester, New York, the employer did not enforce the use of fall protection for employees working in the basket of an aerial boom lift 14 feet above lower levels. Employees were allowed to work in an aerial lift without the proper use of Personal Fall Arrest Systems such as "tying off" to the boom basket with a harness and lanyard. NO ABATEMENT CERTIFICATION REQUIRED
