29 CFR 1910.147(c)(4)(i):Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: On or about June 13, 2023, the employer did not ensure that machine specific procedures for the Mondini 2 plate and pack line were utilized prior to service and maintenance of the equipment took place. Employees tasked with cleaning of the powered chain drive removed guarding in place to clean the chain and sprockets. The equipment is cleaned with the chain in operation exposing the employees to the hazardous area.

29 CFR 1910.147(e)(3):Each lockout or tagout device was not removed from each energy isolating device by the employee who applied the device: On or about April 24, 2023, the employer did not ensure that energy isolating devices for Kettle D, located in the hot kitchen, were removed by the employee who applied the device. As service and maintenance was taking place the authorized employee instructed another employee to remove the isolating device for them as they stood at the hazardous area.

29 CFR 1910.212(a)(1):One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: On or about April 24, 2023 the employer did not ensure that effective machine guarding was in place on the Mondini 2 plate and pack line. Conveyors were not guarded to prevent employees from the ingoing nip point between the conveyor and its powered rollers.
