OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm, including severe burns, to employees in that the facility, processes, and equipment, including the combustible dust collection system, were not designed, constructed, equipped, and located, to protect employees from fire and explosion hazards:  (a) Building 2, Wood Laminator Line - On or about April 25, 2023, the dust collection system, which collected combustible dust from the Wood Laminator Line, did not have fire and explosion prevention/protection systems, including:  ? The Donaldson Torit dry-type dust collector, model 64P JD10, serial number IG560601-01, was located inside the building; ? The Donaldson Torit dry-type dust collector, model 64P JD10, serial number IG560601-01 had no deflagration venting or deflagration suppression or inerting systems; ? The dust collection system had no isolation device to prevent fires and explosions/deflagrations from propagating from the dust collector back through the inlet ductwork to Wood Laminator Line machinery and equipment; ? There was no isolation valve between the plastic tote (used to collect combustible dust discharged from the Donaldson Torit dry-type dust collector, model 64P JD10, serial number IG560601-01) and the dust collector.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR  1910.178(l)(4)(ii)(B):  Refresher training, including an evaluation of the effectiveness of that training, was not conducted as required by paragraph (l)(4)(ii) when the operator had been involved in an accident or near-miss incident to ensure that the operator had the knowledge and skills needed to operate the powered industrial truck safely:  (a) Patrick Industries, 20 Eby Chiques Road, Mount Joy, Pennsylvania - The employer did not provide refresher training and an evaluation on the training's effectiveness to each powered industrial truck operator involved in a near-miss incident, including to an operator who had material slide off the forks while driving and an operator who hit a building structure, on or about March 8, 2023.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR  1910.307(c): Equipment, wiring methods, and installations of equipment in hazardous (classified) locations were not intrinsically safe, approved for the hazardous (classified) location, or safe for the hazardous (classified) location:  (a) Building 2, Wood Laminator Line - The fan on the Trim Bin pulled trimmings, along with Class II combustible dust, through ductwork into the Trim Bin.  The fan had general purpose wiring, not approved for Class II, Division 1 locations, exposing employees to fire and explosion hazards, on or about April 25, 2023.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR  1910.1200(f)(6): Except as provided in paragraphs (f)(7) and (f)(8) of this section, the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the following information:  (i) Identity of the hazardous chemicals contained therein; and, (ii) Appropriate hazard warnings, or alternatively, words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemical:  (a) Building 2, Wood Laminator Line - The plastic tote, used to collect combustible dust discharged from the Donaldson Torit dry-type dust collector, model 64P JD10, serial number IG560601-01, had no label, tag, or marking indicating the identity and appropriate hazard warnings for combustible dust, on or about April 24, 2023.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
