29 CFR 1926.451(e)(1):When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. On or about April 24, 2023, and times prior thereto, employees working from a multi tiered scaffolding system was not provided with a ladder for the employees to safely access the scaffold system exposing them to fall hazards.

29 CFR 1926.1153(c)(1):For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. On or about April 24, 2023 and times prior thereto, employees engaged in construction tasks exposed to respirable silica were not being protected by the use of engineering controls, work practices and respiratory protection with regard to respirable crystalline silica (RCS).

On or about April 24, 2023, and times prior thereto, the employer did assess the exposure for employees using a handheld masonry saw to cut concrete which caused employees to be potentially exposed to respirable crystalline silica (RCS).
