29 CFR  1910.107(b)(5)(i):The spraying operations except electrostatic spraying operations shall be so designed, installed and maintained that the average air velocity over the open face of the booth (or booth cross section during spraying operations) shall be not less than 100 linear feet per minute. Electrostatic spraying operations may be conducted with an air velocity over the open face of the booth of not less than 60 linear feet per minute, or more, depending on the volume of the finishing material being applied and its flammability and explosion characteristics. Visible gauges or audible alarm or pressure activated devices shall be installed to indicate or insure that the required air velocity is maintained. Filter rolls shall be inspected to insure proper replacement of filter media.  On or about April 24, 2023, the average air speed over the open face of the paint spray booth was less than 100 linear feet per minute.    Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.13(c).

29 CFR  1910.107(g)(2): Cleaning. All spraying areas shall be kept as free from the accumulation of deposits of combustible residues as practical, with cleaning conducted daily if necessary. Scrapers, spuds, or other such tools used for cleaning purposes shall be of nonsparking material.  (A)  All spraying areas were not kept as free from the accumulation of deposits of combustible residues and/or tools used for cleaning purposes were not of nonsparking material as required.  On or about April 24, 2023, employees were exposed to fire hazards.   Spraying areas in the spray booth were not kept as free from accumulation of deposits of combustible residues, as practical, with cleaning conducted daily, if necessary.  Overspray outside the  paint booth was also found.  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1910.151(c):Where the eyes or body of any person may be exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body shall be provided within the work area for immediate emergency use. [63 FR 33450, June 18, 1998].  On or about August 1, 2023, employees were servicing battery-run powered industrial vehicles and were exposed to corrosive materials, such as battery acid.    There was no eyewash station in the vicinity of the charging station to quickly drench the eyes of the employees in the event of exposure to corrosive substances in the garage.  Abatement documentation is required of this item in accordance with the requirements of CFR 1903.19(d).

29 CFR  1910.1200(e)(1):The employer did not develop, implement and maintain at the workplace, a written hazard communication program which at least describes how the criteria specified in 29 CFR 1910.1200 (f), (g) and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met and which also includes the following:  1)  Requirement for labeling and other forms of warning;   2) Safety data sheet availability; 3)Employee information and training; 4) A list of hazardous chemicals known to be present in the  workplace; 5)Methods to inform employees of the hazards on non-routine tasks;  a. On or about April 24, 2023, the employer exposed their employees to respiratory and health hazards from chemicals such as, but not limited to, the Rust-oleum Orange Specialty Fluorescent Spray Can .The employer, United Steel & Fasteners, Inc. did not develop, implement, and maintain at the workplace a written hazard communication which at least describes how the criteria specified in 29 CFR 1910.1200(f), (g),  and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met.    b. The employer, United Steel & Fasteners, Inc. did not develop, implement, and maintain at the workplace a written hazard communication which at least describes how the criteria specified in 29 CFR 1910.1200(f), (g),  and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met.      Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1910.1200(h)(1):Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  a.  On or about April 24, 2023, employees were exposed to respiratory and health hazards through the use of aerosol spray cans when spray painting the switch stands specifically the orange handles.  The employees were not provided with effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced in their work areas.  b.   On or about August 1, 2023, employees were servicing battery-run powered industrial vehicles and were exposed to health hazards such as corrosive materials, specifically, battery acid/sulfuric acid.
