29 CFR 1926.20(b)(1): The employer did not initiate and maintain such programs as may be necessary to comply with this part. a. On or about April 24, 2023, at a worksite in Cape Coral, Florida, the employer exposed employees to fall hazards, in that employees were working atop a newly constructed second floor, were attempting to stand-up a wall, comprised of 2x4 studs, which was 9 feet tall and 15 feet wide and weighed approximately 360 pounds, wherein the crew lost their balance and in turn lost control of the wall, causing the crew to slip and fall, and during which time the employer did not initiate and maintain safety programs to ensure compliance with fall hazard recognition and prevention.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: a. On or about April 24, 2023, at a worksite in Cape Coral, Florida: the employer exposed employees to fall hazards, in that fall protection training was not provided while performing framing work at approximately 11 feet high.
