OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to being struck by the excavator bucket. a. Stover Excavation, Inc at a worksite located at 9850 Innovation Campus Way, New Albany, OH 43054: On or about April 25, 2023, employees were exposed to struck-by hazards from an excavator bucket that had not been adequately checked for a secure connection to the quick coupler on a Caterpillar Model 349 excavator. The excavator bucket was initially checked to ensure it was engaged to the 349E TB Link Pin Grabber Quick Coupler, the bucket attachment was moved to the edge of the excavation and bump checked a second time above an employee who was working in the excavation.

29 CFR 1926.652(a)(1):Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: a. Stover Excavation, Inc at a worksite located at 9850 Innovation Campus Way, New Albany, OH 43054: On or about April 25, 2023, the employer did not ensure employees were protected from cave-ins by a compliant protective system while performing work in an excavation that was more than five feet in depth. Employees worked in areas of an excavation up to 7 feet deep on a sanitary sewer line without a means of cave-in protection in place. The following condition exposed employees to struck-by/caught-in hazards.
