29 CFR 1926.652(a)(1): Employees in an excavation were not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  (a)The Comfort Heroes, LLC dba Comfort Heroes Plumbing Heating Air at 1608 South Park Avenue, Sioux Falls, SD 57105:  On or about and at times prior to April 25, 2023, the employer did not ensure that employees were protected by an adequate protective system while working within an excavation that was greater than five feet in depth.  This condition exposed employees to stuck-by and cave-in hazards associated with trench wall collapse.

29 CFR  1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:  (a)The Comfort Heroes, LLC dba Comfort Heroes Plumbing Heating Air at 1608 South Park Avenue, Sioux Falls, SD 57105:  On or about and at times prior to April 25, 2023, the employer did not ensure an accident prevention program was developed and implemented for the work environment to include daily inspections of excavations, the adjacent areas, and protective systems by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions.  This condition exposed employees to struck-by and cave-ins associated with a lack of a protective system.
