OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees that were exposed to explosion and fire hazards from asphalt operations: a) On or about April 25, 2023, at 12460 New Ave., Lemont, IL 60439, employees and contractor employees were exposed to fire and explosion hazards during asphalt operations such as but not limited to the transfer of asphalt and asphalt like materials into storage tanks.

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6): a) Location Poly Building - On or about August 16, 2023, an employee was exposed to burns hazards associated with servicing a steam leak outside the Poly Building. The employer failed to implement energy control application steps as the steam line was not locked out or blocked while perform the servicing work [per the 1910.147(d)(2) requirements]. As a result, the remaining applicable energy control elements, involving isolation [(d)(3)], LOTO device application [(d)(4)], dissipation of residual energy [(d)(5)((i)], and verification of isolation [(d)(6)], were not implemented to protect employees from steam line servicing hazards.

29 CFR 1910.1200(h)(3)(ii): Employee training did not include the physical and health hazards of the chemicals in the work area: a) On or about April 25, 2023, in the facility located at 12460 New Ave, Lemont, IL 60439, all employees had not been trained with effective information on hazardous chemicals in their work areas such as, but not limited to, hydrogen sulfide when gauging and transferring asphalt to and from asphalt tank and tanker trucks throughout the facility.

29 CFR 1910.146(c)(2): The employer did not inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces: NOTE: A sign reading DANGER -- PERMIT REQUIRED CONFINED SPACE, DO NOT ENTER or using similar language would satisfy the requirement for a sign. a) On or about April 25, 2023, at 12460 New Ave, Lemont, IL, the employer had not posted danger signs of the existence and location of the danger posed by the permit-required space. The location where the danger signs were not posted includes but is not limited to the side hatch door on Asphalt Tank 37.
