29 CFR  1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them:  (a)Gold State Quality Construction 2, LLC at 1962 Russell Street, Spearfish, SD 57783: On or about and at times prior to April 26, 2023, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees were conducting framing operations on a multi-family residential property without the use of a fall protection system, not using properly installed ladders while accessing and egressing the top plates of framed walls, lack of training, and a lack of Personal Protective Equipment (PPE).  This condition exposed employees to fall and struck-by hazards.  (b)Gold State Quality Construction 2, LLC at 1970 Russell Street, Spearfish, SD 57783: On or about and at times prior to April 26, 2023, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. 29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:  (a)Gold State Quality Construction 2, LLC at 1962 Russell Street, Spearfish, SD 57783: On or about and at times prior to April 26, 2023, the employer did not ensure that each employee that was installing floor joists and sheathing with the use of a pneumatic nail gun was protected from flying particles by the use of appropriate eye protection.  This condition exposed employees to struck-by hazards.

This exposed the employees to fall hazards greater than 6 feet.  (b)Gold State Quality Construction 2, LLC at 1970 Russell Street, Spearfish, SD 57783: On or about and at times prior to April 26, 2023, the employer did not ensure that employees were properly trained on the use of ladders or the ability to recognize the hazards of using ladders when accessing landing surfaces of framed wall top plates or installed floor joists.
