OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause serious physical harm to employees in that employees were exposed to crushed-by hazards:  a) On or about April 25, 2023, in the truck loading area outside the paint booth, employees operating a Hyster S50CT forklift to load metal stock onto a flatbed trailer were exposed to crushed-by hazards where seat belts were not used.

The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.  a) On or about April 25, 2023, inside the paint booth, employees are required to utilize 3M half-face respirators with 5101 Cartridges while painting parts without first acquiring a medical evaluation.
