OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by the load should the components of the lifting devices fail. a) At Fair Point Marina, 14990 West Bay Rd, Fair Haven NY - Near the edge of the bay. On or about 4/26/2023, employees were using a spreader bar that was rusted and did not have the rated load capacity markings or manufacturer's markings. The spreader bar was attached below the hook of a crane and used to hoist and lower dock sections into the bay exposing employees to struck by hazards. Among other feasible and acceptable means of abatement would be to: 1. Mark the rated load capacity on the device in accordance with the American Society of Mechanical Engineers, ASME B30.20 -2013, section 20-1.2. 2. Purchase a spreader that has the manufacturer's markings and rated load capacity on the device in accordance with the American Society of Mechanical Engineers, ASME B30.20 -2013, section 20-1.2.

On or about 4/26/2023, employees were hoisting and placing dock sections in the water. The steel chains and wire rope slings attached to a spreader bar, that was being used to hoist and lower dock sections, did not have affixed and legible identification markings including, but not limited to the rated load capacity markings or manufacturer's markings - exposing employees to struck by hazards.
