29 CFR  1910.38(a): The emergency action plan (EAP) required by 29 CFR 1910.157(a) or (b) when the employer has elected to partially or totally evacuate the workplace in the event of a fire emergency, or required by 29 CFR 1910.160(c)(1), did not cover the designated actions that the employer or employees must take to ensure employee safety from the fire and other emergencies:  On or about April 27, 2023, Functional Building Supply Co. located at 18598 Cranwood Parkway Warrensville Heights, OH 44128, had deficiencies in their EAP. The employer did not develop and review the EAP with each employee in the Fab Shop, Warehouse and Admin office to include the evacuation routes and emergency exit locations.

29 CFR  1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program which at included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):  On or about April 27, 2023, Functional Building Supply Co. located at 18598 Cranwood Parkway Warrensville Heights, OH 44128, the employer did not have a written hazard communication program in place. Employees were exposed to hazardous chemicals to include but not limited to Evercoat Optex Filler, Geocel� 4500? Roof Bonding Sealant, and ProBlock� Primer (Aerosol) used within the Fab Shop.

29 CFR  1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  On or about April 27, 2023, employees tasked to operate two propane forklifts (Clark Serial # GX230-1808-7158K0F & Komatsu Model #AFG25ST-16  Serial #A451130) at 18598 Cranwood Parkway Warrensville Heights, OH 44128 were not provided effective information and training on the carbon monoxide and carbon dioxide hazards associated with propane-powered equipment used indoors.
