OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling from/struck by the excavator components while working in the bucket of the excavator that was being used to remove aluminum siding from a building:   a) While removing aluminum siding on the side of a 1 ? story building located at 124 Deerfield Road, Seabrook, NJ. An employee was observed inside the bucket and was raised to approximately 15 in the air to remove aluminum siding from the side of the building by a JCB JS145LC model excavator.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
