Employees were exposed to tripping/falling into uncovered holes while walking/working next to the scaffold, on or about 04/26/2023.   Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR  1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity).   a) Worksite, 4180 Sunrise Highway, Oakdale, NY, : Employees were working at a height of approximately 20 ft. on a fabricated frame scaffold with missing midrails, and top rails; on or about April 26, 2023.  Danco Construction Unlimited Inc.  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1)(vii), which was contained in OSHA inspection number 1390196, citation number 1, item number 3 and was affirmed as a final order on 01-29-2020, with respect to a workplace located at 8 Basket Neck Lane, Remsenburg, NY.  Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR  1926.451(h)(2)(ii): A toeboard was not erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below:  a) Worksite, 4180 Sunrise Highway, Oakdale, NY, 11769. Employees were installing concrete block while working from a fabricated frame scaffold that was missing toe boards; on or about April 26, 2023.   Danco Construction Unlimited Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(h)(2)(ii), which was contained in OSHA inspection number 1390196, citation number 1, item number 4 and was affirmed as a final order on 01-29-2020, with respect to a workplace located at 8 Basket Neck Lane, Remsenburg, NY.  Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
