29 CFR  1910.178(l)(4)(iii):An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years.  (a) On or about April 27, 2023, the employer had not conducted a performance evaluation of employees authorized to operate forklift(s) every three years.  Nature-Tech, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1910.178(l)(4)(iii), which was contained in OSHA inspection number 1601772, citation number 1, item number 2a and was affirmed as a final order on 12/12/2022, with respect to a workplace located at 5400 W. Good Hope Rd. Milwaukee, WI 53223.

29 CFR  1910.178(l)(6):Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.  (a) On or about April 27, 2023, the employer did not certify that each operator of powered industrial fork trucks in the warehouse area had been trained and evaluated.  Nature-Tech, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1910.178(l)(6), which was contained in OSHA inspection number 1601772, citation number 1, item number 2b and was affirmed as a final order on 12/12/2022, with respect to a workplace located at 5400 W. Good Hope Rd. Milwaukee, WI 53223.

29 CFR  1910.1200(e)(1):Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:  (a) On April 27, 2023, the employer failed to develop a written a hazard communication program consisting of specific procedures, training materials,  and how training is conducted for employees working with compounds such as wood dust, solvents, laminates, thinners, and paints, which may present toxicity, flammability, and carcinogenic hazards to employees in the entire facility.  Nature-Tech, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.1200(e)(1), which was contained in OSHA inspection number 1601772, citation number 1, item number 3a and was affirmed as a final order on 12/12/2022, with respect to a workplace located at 5400 W. Good Hope Rd. Milwaukee, WI 53223.
