OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to fall hazards from an all-terrain forklift. (a) On or about April 27, 2023, at the job site located at W214N4987 Casey Court, Menomonee Falls WI, 53051, employees working from an elevated metal platform on the forks of a Gradall JLG rough terrain forklift, model 544D-10, serial # 0160001340 at a height of approximately 13.5 feet above the ground level were not utilizing fall protection, exposing the employees to the hazard of a fall from elevation.
