29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: Location: 163 Fabyan Place. Newark, NJ 07112 a) The employer did not administer a hearing conservation program for employees operating machinery in the warehouse that were exposed to noise levels above the action level. On April 27, 2023 three employees operating a flute machine and an angleboard machine were exposed to noise levels above the 10-hour action level of 82.1 decibels on the A scale. Employees were exposed to continuous noise levels that were equivalent to 83%, 86.4%, and 94.2% of the allowable dose of 100%, or 90dBA for as the Permissible Exposure Limit (PEL). Employees were exposed to noise levels of 88.6 dBA, 88.9 dBA, and 89.5 dBA, respectively. Employees were sampled for 273 minutes, 491 minutes, and 508 minutes. Zero exposure is assumed for the unsampled times of 327 minutes, 109 minutes, and 92 minutes of the 10-hour work shift. Violation occurred on or around April 27, 2023.
