29 CFR  1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift. Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated.  a) Rear of the Carriage House: On or about 4/28/2023, an employee was permitted to perform work while utilizing an aerial lift without any means of fall protection.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b).  a) Jobsite: On or about 4/28/2023, the employer did not ensure that an employee engaged in residential roofing activities, at heights of approximately 18 feet above the lower level, was protected from fall hazards.
