OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to struck by and or struck against injuries while working in a scissor lift not properly inspected or maintained to ensure the control panel was secured.  a) On or about 04/25/2023, at Innovative Square, located on 100 South Clinton Avenue, in Rochester, New York, the employer did not enforce operator safety practices for employees working from a scissor lift (SkyJack SJ111 3219  S/N: 23106).  Employees were allowed to operate a scissor lift without performing a visual inspection of the lift and without reading the operating manual as required by the manufacturer.  Employees were exposed to struck by and or struck against hazards due to an unsecured control console, which was not secured in place with the provided locking pin.  NO ABATEMENT CERTIFICATION REQUIRED
