29 CFR  1926.100(a):  Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  a) On April 28, 2023, at the above addressed jobsite, an employee was exposed to struck-by hazards from falling tools, materials, and debris when working below an employee performing commercial carpentry operations from an aerial lift. The employee was not wearing a protective helmet.

29 CFR  1926.303(b)(1):  Grinding machines were not equipped with safety guards in conformance with the requirements of American National Standards Institute, B7.1-1970, Safety Code for the Use, Care and Protection of Abrasive Wheels, and paragraph (d) of this section.  (a) On or about April 28, 2023, at the above referenced jobsite, grinding machines were not equipped with safety guards in conformance with the requirements of American National Standards Institute and/or paragraph (d) of 29 CFR 1926.303 as required.

29 CFR  1926.453(b)(2)(v):  A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:  a. On or about April 28, 2023, at the above addressed jobsite, an employee performing exterior carpentry operations from a JLG aerial lift, approximately nine (9') feet above the ground, was not wearing a personal fall arrest system, thereby exposing the employee to fall hazards.  Peter Michael Realty Inc. was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.453(b)(2)(v), which was contained in OSHA inspection number 1398179, citation number 1, item number 1 and was affirmed as a final order on June 18, 2019, with respect to a workplace located at 880 Roosevelt Road, Glen Ellyn, Illinois.
