29 CFR 1910.95(g)(5)(i): The employer did not establish, within 6 months of an employee's first exposure at or above the action level, a valid baseline audiogram against which subsequent audiograms can be compared: On or about April 24, 2023, and at times prior thereto, at this refinery turnaround project, where employees were exposed to noise hazards without a valid baseline audiogram in place: a. The Breathing Air Technician was exposed to a noise level of 88.1 dBA during a 472 minutes sampling period; and, b. The Breathing Air Technician was exposed to a noise level of 86.8 dBA during a 480 minutes sampling period.

29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels: On or about April 24, 2023, and at times prior thereto, at this refinery turnaround project, where employees were exposed to noise hazards without annual hearing tests available to exposed employees: a. The Breathing Air Technician was exposed to a noise level of 88.1 dBA during a 472 minutes sampling period; and, b. The Breathing Air Technician was exposed to a noise level of 86.8 dBA during a 480 minutes sampling period.
