29 CFR  1910.1200(g)(8):  The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s)  At the jobsite located at Lot 54 Bristol Highlands, Lenexa, Kansas, employees performing masonry activities were exposed to hazardous chemicals including but not limited to Respirable Crystalline Silica which is a skin irritant, can cause serious eye damage, respiratory irritation, and may cause cancer. The employer did not maintain copies of the safety data sheets for the Crystalline Silica.

29 CFR  1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:   At the jobsite located at Lot 54 Bristol Highlands, Lenexa, Kansas, employees performing masonry activities were exposed to hazardous chemicals including but not limited to Respirable Crystalline Silica which is a skin irritant, can cause serious eye damage, respiratory irritation, and may cause cancer without being provided with information and training on how to recognize, avoid and/or eliminate the hazards associated with Respirable Crystalline Silica.

29 CFR  1926.1153(c)(1):For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1.  At the jobsite located at Lot 54 Bristol Highlands, Lenexa, Kansas, employees performing masonry activities, dry cutting on stone and mixing mortar were exposed to silica hazards. The employer failed to implement engineering and work practice controls as outlined in Table 1 to reduce employee exposure to silica dust.

29 CFR  1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer.   At the jobsite located at Lot 54 Bristol Highlands, Lenexa, Kansas, employees engaged to masonry activities were exposed to respiratory hazards. Employees using N95 respirators voluntarily were not provided with information contained in appendix D of the standard.
