29 CFR 1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: (a) On or about May1, 2023 and at times prior thereto, employees performing work at the worksite located at 4931 Grisham Drive, Rowlett, Texas 75088 were exposed to noise levels of 89.1-91.4 dBA in the welding booths and noise levels of 95.5-102.4 dBA in the sandblasting room without benefit of a continuing, effective hearing conservation program.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (a) On or about May 1, 2023 and at times prior thereto, in the sandblasting room within the worksite located at 4931 Grisham Drive, Rowlett, Texas 75088, during sandblasting operations, the sandblast operators were required to use a supplied-air hood respiratory protection system without benefit of a written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures for required respirator use.
