29 CFR  1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, was not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.   a) 400 Mill Road Wilmington, DE 19806 (Stairwells): On or about May 1, 2023, and days prior, employees were exposed to fall hazards when the employer failed to ensure a top rail were properly installed with a top edge height of the top rail 42 inches plus or minus 3 inches.

29 CFR 1926.502(b)(2): Midrails, screens, mesh, intermediate vertical members, or equivalent intermediate structure members were not installed between the top edge of the guardrail system and the walking/working surface when there was no wall or parapet wall at least 21 inches (53 cm) high.  a) 400 Mill Road Wilmington, DE 19806 (Fifth floor): On or about May 1, 2023, and days prior, employees were exposed to fall hazards when the employer failed to ensure wood framed guardrail systems were properly installed with a mid-rail, screen, mash, or intermediate vertical member edge height of 21 inches.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501   a) 400 Mill Road Wilmington, DE 19806 (Fourth floor): On or about May 1, 2023, and days prior, employees exposed to a fall hazards when working 40 feet above grade while framing a residential construction project without a personal fall arrest system.  Paulo Braz was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.501(b)(13), which was contained in OSHA inspection number 1552496, citation number 1, item number 2 and was affirmed as a final order on 12-2-2021, with respect to a workplace located at Lot 80 - Kayla Lane Townsend DE, 19734.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    a) 400 Mill Road Wilmington, DE 19806: On or about May 1, 2023, and days prior, employees were exposed to fall hazards when they were not adequately trained in proper fall protection standards, methods, and concepts which resulted in several hazardous conditions that exposed employees to fall hazards when they were performing construction activities.  The Paulo Braz was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.503(a)(1), which was contained in OSHA inspection number 1552496, citation number 1, item number 3 and was affirmed as a final order on 12-2-2021, with respect to a workplace located at Lot 80 - Kayla Lane Townsend DE, 19734.
