29 CFR  1910.1030(f)(3): Following a report of an exposure incident, the employer did not make immediately available to the exposed employee a confidential medical evaluation and follow-up:  a) Facility: On or about 4/25/2023, the employer did not provide a confidential medical evaluation to an employee that was cut with a scalpel that had been used to perform a gynecological procedure on a patient.   NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1910.1030(f)(3)(iii)(A): The post-exposure evaluation and follow-up of an exposure incident did not include the collection of the exposed employee's blood as soon as feasible and test for HBV and HIV serological status after consent was obtained:  a) Facility: On or about 4/25/2023, An employee's blood was not tested immediately to determine HBV and HIV infectivity after an employee was cut by a scalpel that had been used on the source to perform a gynecological procedure on a patient.
