29 CFR  1910.147(c)(4)(i):Procedures shall be developed, documented and utilized for the control of potentially hazardous energy when employees are engaged in the activities covered by this section.   On or about May 2, 2023, at an establishment located at 2000 Verlin Road, Green Bay, Wisconsin: the employer did not develop and document energy control procedures, including die setting procedures for the Cincinnati hydraulic brake presses to address the hazardous energies associated with the equipment, exposing employees to crushing hazards.   a) employees did set up activities, for example, die-setting on the Cincinnati hydraulic brake press serial number 56951, exposing employees to hazards, including but not limited to, getting caught-in and struck-by moving machine parts.   b) employees did set up activities, for example, die-setting on the Cincinnati hydraulic brake press serial number 055932, exposing employees to hazards, including but not limited to, getting caught-in and struck-by moving machine parts.   Note: Exception: The employer need not document the required procedure for a particular machine or equipment, when all of the following elements exist: (1) The machine or equipment has no potential for stored or residual energy or reaccumulation of stored energy after shut down which could endanger employees; (2) the machine or equipment has a single energy source which can be readily identified and isolated; (3) the isolation and locking out of that energy source will completely deenergize and deactivate the machine or equipment; (4) the machine or equipment is isolated from that energy source and locked out during servicing or maintenance; (5) a single lockout device will achieve a locker-out condition; (6) the lockout device is under the exclusive control of the authorized employee performing the servicing or maintenance; (7) the servicing or maintenance does not create hazards for other employees; and (8) the employer, in utilizing this exception, has had no accidents involving the unexpected activation or reenergization of the machine or equipment during servicing or maintenance.

29 CFR  1910.178(l)(2)(ii): Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  On or about May 2, 2023, at an establishment located at 2000 Verlin Road, Green Bay, Wisconsin: the employer did not ensure employees who operated the sit down propane forklift completed a formal training program. Unevaluated and trained employees were using the forklift to load and unload trucks.

On or about May 2, 2023, at an establishment located at 2000 Verlin Road, Green Bay, Wisconsin: the employer did not evaluate each powered industrial truck operator's performance to ensure they had the knowledge and skill to operate safely. Unevaluated and trained employees were using the forklift to load and unload trucks.

29 CFR  1910.178(q)(7):Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  On or about May 2, 2023, at an establishment located at 2000 Verlin Road, Green Bay, Wisconsin: an Mitsubishi Laser Processing Machine model: ML3015eX(S), S/N: 6630eXS673 exposed employees to caught between hazards during the machines table feed change operation.

29 CFR  1910.212(a)(3)(ii):The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle.  On or about May 2, 2023, at an establishment located at 2000 Verlin Road, Green Bay, Wisconsin: employees used a foot pedal to operate the Cincinnati hydraulic brake press serial number 055932 to bend work pieces. The guard was adjusted to an opening greater than one-quarter inch allowing employees access to the point of operation and danger zone of the operating cycle.

29 CFR  1904.39(a)(2):Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.  On or about May 2, 2023, at an establishment located at 2000 Verlin Road, Green Bay, Wisconsin: an employee suffered a partial amputation of the left index finger when his finger was caught in the Cincinnati hydraulic brake press serial number 56951. The employer did not report the amputation within 24 hours.
