29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use.  On or about May 2, 2023, and at times prior thereto, employees grinding and sanding granite countertop material were required to wear a respirator, exposing employees to an undue physiological burden and to unforeseen medical issues. The employer did not implement a written respiratory protection program to include but not limited to the following instances (a-d): a) Ensuring employees were medically cleared to wear a respirator. b) Ensuring respirators were stored to protect against contamination. c) Prohibiting facial hair to ensure a good respirator to face seal.  d) Training on proper use and care of respirators.

29 CFR  1910.147(c)(1):The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.  On or about May 2, 2023, maintenance and machine operating employees were exposed to unexpected energizing, start up or release of stored energy while working on the stone cutting machine.
