29 CFR 1926.20(b)(2):  The employer did not provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers:  (a)TexaKota Builders LLC at 5220 South Marion Road, Sioux Falls, SD 57108: On or about and at times prior to April 6, 2023, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment; conducted by a competent person. Employees were conducting framing operations on a residential property without the use of fall protection, lack of PPE, and lack of training prior to being exposed to hazards. This condition exposed employees to fall and other hazards while working on the site.

29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  (a)TexaKota Builders LLC at 5220 South Marion Road, Sioux Falls, SD 57108: On or about and at times prior to April 6, 2023, the employer did not ensure that employees that were installing floor joists with the use of a pneumatic nail guns were protected from flying particles by the use of appropriate eye protection.  This condition exposed employees to struck-by hazards.

29 CFR 1926.501(b)(13): Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a)TexaKota Builders LLC at 5220 South Marion Road, Sioux Falls, SD 57108: On or about and at times prior to April 6, 2023, the exposing employer did not ensure employees were properly anchored/tied off while performing framing work on a residential property. Observed employees were wearing fall protection systems but were not hooked up and employees were not using the personal fall protection systems correctly. This condition exposed employees to falls greater than six feet while working on site.

This condition exposed employees to fall hazards greater than six feet.
