29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. Location at 7075 Long Road Canal Winchester 43110, Building 4 : On or about May 04, 2023,  the employer did not ensure that employees performing siding work while standing on the first floor roof and the third floor balcony at heights exceeding 19 feet were protected from falls. Thereby exposed the employees to falls of up to approximately 19 feet 9 inches to the ground below.

29 CFR  1926.1053(b)(5)(i): Non-self-supporting ladder(s) were not used at an angle such that the horizontal distance from the top support to the foot of the ladder was approximately one-quarter of the working length of the ladder.   a. Location at 7075 Long Road Canal Winchester 43110, Building 4 : On or about May 04, 2023, an employee was performing siding work on a three story apartment building while using an extension ladder to ascend and descend the work area carrying a box of siding materials that was positioned with the horizontal distance from the top support to the foot set at three-quarters of the working length of the ladder, approximately 53.4 degrees. Thereby exposed the employee to a fall of approximately 10 feet 5 inches to the ground below.

29 CFR  1926.1053(b)(22): Employees using ladders were carrying objects or loads that could cause the employee to lose balance and fall:  a.Location at 7075 Long Road Canal Winchester 43110, Building 4 : On or about May 04, 2023, an employee was using an extension ladder to transport a large bundle of siding materials from the ground to the first floor roof landing. Thereby exposed the employee to a fall of up to approximately 10 foot 5 inches to the ground below.
