29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a) 13 Matthews Street, Williamstown NJ: The employer did not ensure that each worker who utilized a Pettibone All-Terrain Traverse lift  at the worksite had received training which included formal instruction, hands on and an evaluation with a written certification of completion, on or about 05/04/23. On or about 05/04/23 the company worksite Foreman was delivering floor trusses to his workers using and while operating the worksite Traverse lift at the worksite.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.416(e)(1): Worn or frayed electric cords or cables were used:  a- 13 Matthews Street, Williamstown NJ: On or about  05/04/23 a portable electric circular saw, in use by the workers, was observed being powered with a flexible extension cord that contained exposed, uninsulated, uncovered wires.   b - 13 Matthews Street, Williamstown NJ: On or about  05/04/23 a portable electric circular saw, in use by the workers, was observed being powered with a flexible cord that had been repaired on site by the company worksite Foreman after it had been damaged.  The reparied cord was repaired using red tape.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a- 13 Matthews Street, Williamstown NJ: Workers and the company worksite Foreman were exposed to fall hazards, in excess of 11 feet 6 inches to the ground surface below, when walking and working from the top plates of a residential structure's outer wall frames while not using fall protection.  Condition observed on or about 05/04/23.   b - 13 Matthews Street, Williamstown NJ: Workers and the company worksite Foreman were exposed to fall hazards, in excess of 8 feet 3 inches to the flooring below, when walking and working from unsecured floor trusses and the top plates of a residential structure's inner wall frames while not using fall protection.  Condition observed on or about 05/04/23  c - 13 Matthews Street, Williamstown NJ: Workers and the company worksite Foreman were exposed to fall hazards, in excess of 16 feet 11 inches to the basement flooring below, when walking and working from unsecured floor trusses and the top plates of a residential structure's inner wall frames (set above an unprotected floor opening leading to the basement) while not using fall protection.  Condition observed on or about 05/04/23.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLSULTY WILL RE IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
