29 CFR 1926.1053(b)(1): Because of the portable ladder's length, the ladder side rails did not extend to at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access and the ladder was not secured at its top. On or about May 3, 2023, an employee was in use of a ladder and the side rails of the ladder did not extend at least three (3) feet above the landing. This exposed the employee to a fall hazard.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed. On or about May 3, 2023, employees were in use of an A-framed ladder in the closed position leaned against the wall of a trench. The ladder was not being used for the purposes for which it was designed and this exposed employees to a fall hazard.
