29 CFR  1910.95(g)(1):The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels:  Worksite: When an employee was conducting stone-cutting operations was exposed to noise in excess of the OSHA Action Level of 85 decibels as an 8-hour  Time-Weighted Average (TWA), and the employer did not institute a continuing, effective hearing conservation program including, but not limited to, an audiometric testing program:  Slab Cutting Area: On or about May 18, 2023, a Slab Cutter was conducting cutting of a large slab of bluestone.  This employee was overexposed to continuous noise at a level of 87.4 dBA.  This level of exposure is 1.09 percent of the OSHA Action Level of 85 dBA, measured as an 8-hour Time Weighted Average.  The worker was sampled for 428 minutes.  Zero exposure was assumed for any unsampled time.

29 CFR  1910.134(d)(1)(i):Selection of appropriate respirators was not based on the respiratory hazard(s) to which the worker was exposed and user factors that affect respirator performance and reliability:  Facility: On or about 05/18/2023, when the employer supplied a half-mask elastomeric respirator to a worker as protection during stone fabrication work the respirator was outfitted with cartridges effective against organic vapors.  These cartridges do not offer protection against the fine crystalline silica dust produced during stone cutting and grinding operations.

29 CFR  1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function:  Facility: On or about 05/18/2023, when the employer issued a half-mask elastomeric respirator to a worker as protection against crystalline silica dust, the employer allowed the worker to wear the respirator with interfering facial hair.  This prevented an effective face-to-facepiece seal when the worker conducted stone cutting operations.
