29 CFR  1926.451(c)(2)(i): Footings shall be level, sound, rigid, and capable of supporting the loaded scaffold without settling or displacement.  On or about May 4, 2023,  on the west side of building,  the employees were performing stucco work on exterior wall of building from a scaffold with footings unlevel and not  capable of supporting the loaded scaffold without settling or displacement.

29 CFR  1926.451(e)(1):When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  On or about May 4, 2023, on a construction site located in Conroe, Texas, two employees were working from a scaffold platform without a proper point of access, the employees used the cross bracing as a ladder.

29 CFR  1926.451(g)(1)(v):Each employee on a walkway located within a scaffold was not protected by a guardrail system (with a minimum 200 pound top rail capacity) installed within 9.5 inches (24.1 cm) of and along at least one side of the walkway.  On or about May 4, 2023, two employees were performing stucco work to the exterior while using a walkway that was not protected by a guardrail system.

On or about May 4, 2023,  at a construction site in Spring, Texas,  two employees were conducting stucco work on the  exterior wall from a scaffold platform more than 10 above a lower lever that was not protected by a personal fall arrest systems or guardrail systems.
