29 CFR 1910.147(c)(1):The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: a) Warehouse - On May 4, 2023, the employer did not develop, document, or utilize an energy control program (lockout/tagout program), that included an energy control procedure for employees to follow, training to ensure that all required elements of the procedure were understood by employees, including safe application, usage, and removal of the energy isolating controls, and periodic inspections to ensure that employees were protected from injuries caused by the unexpected energizing of equipment or release of stored energy while performing servicing or maintenance on equipment, such as setup and unjamming on the Pearson Case Erector and Rolling Conveyor. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.
