29 CFR 1910.252(c)(2):Ventilation for general welding and cutting. 29 CFR 1910.252(c)(2)(i): General. Mechanical ventilation shall be provided when welding or cutting is done on metals not covered in paragraphs (c)(5) through (c)(12) of this section. 29 CFR 1910.252(c)(2)(i)(A): In a space of less than 10,000 cubic feet (284 m(3)) per welder. (a): On or about March 12, 2023, the employer did not ensure that mechanical ventilation was provided while welding operations were conducted in an an area that was less than 10,000 cubic feet of space. Employees were exposed to respiratory hazards while MIG welding in the refuse area of a garbage truck. (b): On or about March 30, 2023, the employer did not ensure that mechanical ventilation was provided while welding operations were conducted in an an area that was less than 10,000 cubic feet of space. Employees were exposed to respiratory hazards while MIG welding in the refuse area of a garbage truck. An employee received medical treatment for smoke inhalation as a result. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1904.29(b)(3): How quickly must each injury or illness be recorded? You must enter each recordable injury or illness on the OSHA 300 Log and 301 Incident Report within seven (7) calendar days of receiving information that a recordable injury or illness has occurred. (a): On or about April 6, 2023, an OSHA Form 301 or equivalent was not completed by the employer for a work-related injury within seven calendar days. An employee was treated in an emergency room for smoke inhalation after welding in the refuse area of a garbage truck. (b): On or about April 6, 2023, a work-related injury that resulted in medical treatment for an employee was not recorded on the OSHA 300 log within seven calendar days. An employee was injured and subsequently treated in an emergency room for smoke inhalation after welding in the refuse area of a garbage truck. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
