29 CFR 1910.146(c)(4):When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146: On or about May 3, 2023 and at times prior thereto and thereafter, at the 600 line, an employee entered into a tank to perform work and exposed employees to hazardous conditions.

29 CFR 1910.146(c)(9)(iii): Each contractor who was retained to perform permit space entry operations did not inform the host employer of the permit space program that the contractor would follow and of any hazards confronted or created in permit spaces, either through a debriefing or during the entry operation: On or about May 3, 2023, and at times prior thereto and thereafter, for a 600 line tank the host employer was not informed by the contractor of the permit space program to be followed for employee entry into the tank to perform work which exposes employees to hazardous conditions.
