29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them:  (a)H & S Construction at 335 West 1st Street Tea, SD, 57064: On or about and at times prior to May 8, 2023, the exposing employer did not ensure that frequent and regular inspections were conducted by a competent person.  Employees were conducting commercial roofing operations with inadequate fall protection systems, lack of forklift certification, and ladder hazards.  This condition exposed employees to various hazards such as fall hazards, forklift, and ladder hazards.

29 CFR  1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:   (a)H & S Construction at 335 West 1st Street Tea, SD, 57064: On or about and at times prior to May 8, 2023, the exposing employer did not ensure employees were protected from falls while performing roofing operations. Employees were conducting roofing work on a commercial, 8/12 steep pitch roof with no fall protection in place. This condition exposed employees to fall hazards greater than six feet.

29 CFR 1926.502(d): The employer did not ensure that personal fall arrest systems and their use did not comply with the provisions set forth in paragraphs (1) through (24) of this section:   (a)H & S Construction at 335 West 1st Street Tea, SD, 57064: On or about and at times prior to May 8, 2023, the exposing employer employer did not ensure that employees were using appropriate fall arrest systems while performing roofing operations on a commercial property. Employees were utilizing rock climbing equipment while conducting roofing activities in place of fall arrest equipment. This condition exposed employees to  fall hazards greater than six feet.
