29 CFR  1910.38(b): Written and oral emergency action plans. An emergency action plan must be in writing, kept in the workplace, and available to employees for review. However, an employer with 10 or fewer employees may communicate the plan orally to employees.  a) On or about May 5, 2023, employees working at the rock-climbing gym at 2831 Franklin Boulevard, Cleveland, Ohio 44113 were exposed to fire hazards; the employer did not ensure the emergency action plan was communicated orally to each employee.

29 CFR 1910.140(c)(22): Personal fall protection systems must be worn with the attachment point of the body harness located in the center of the employee's back near shoulder level.  The attachment point may be located in the pre-sternal position if the free fall distance is limited to 2 feet (0.6 m) or less.  a) On or about May 5, 2023, employees were route setting using only a body belt as fall protection at 2831 Franklin Boulevard, Cleveland, Ohio 44113; the employer did not ensure employees were protected from a fall hazard of more than 25 feet by use of a personal fall protections system with an attachment point located in the center of the employee's back near the shoulder.
